1. Service Description
1.1 The Company provides a digital picture delivery service (“Service”) to subscribers on a monthly or annual subscription basis.
1.2 Pictures are delivered to subscribers in digital format only.
2. Subscription and Payment
2.1 The Service is available on either a monthly or annual subscription basis, paid in advance.
2.2 Payment for the subscription is due upon sign-up and will automatically renew at the end of each subscription period unless cancelled by the subscriber.
2.3 The Company reserves the right to change the subscription fees with 30 days notice to subscribers.
2.4 All payments are non-refundable.
3. Termination
3.1 Subscribers may terminate their subscription at any time by providing 30 days written notice to the Company.
3.2 The Company reserves the right to terminate a subscriber’s access to the Service for any reason, including violation of these Terms and Conditions.
4. Intellectual Property
4.1 All pictures delivered through the Service are owned by the Company or its licensors and are protected by copyright laws.
4.2 Subscribers are granted a limited, non-exclusive, non-transferable license to use the pictures for personal, non-commercial purposes only.
4.3 Subscribers may not reproduce, distribute, modify, or create derivative works from the pictures without the Company’s prior written consent.
5. Limitation of Liability
5.1 The Service is provided on an “as is” basis without warranties of any kind, express or implied. 5.2 The Company shall not be liable for any indirect, incidental, special or consequential damages arising out of or in connection with the use of the Service.
5.3 The Company’s total liability shall not exceed the subscription fees paid by the subscriber in the 12 months prior to the claim.
6. Governing Law
6.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Gibraltar.
6.2 Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Gibraltar.
7. Changes to Terms and Conditions
7.1 The Company reserves the right to change these Terms and Conditions at any time.
7.2 Continued use of the Service after any such changes shall constitute consent to such changes.
7.3 By subscribing to the Service, subscribers agree to be bound by these Terms and Conditions. If a subscriber does not agree to these Terms and Conditions, they should not use the Service.
